NOTICE OF ADOPTION OF NOTE RESOLUTION

PUBLIC NOTICE is hereby given that: (i) on October 14, 2021, The Merchantville-Pennsauken Water Commission (“Commission”) adopted a note resolution, entitled “RESOLUTION OF THE MERCHANTVILLE-PENNSAUKEN WATER COMMISSION AUTHORIZING THE ISSUANCE AND SALE OF ITS Municipally Guaranteed PROJECT NOTES, SERIES 2021, IN THE PRINCIPAL AMOUNT OF UP TO $2,000,000; DELEGATING TO CERTAIN COMMISSION OFFICIALS THE POWER TO MAKE CERTAIN DETERMINATIONS AND TO AWARD AND SELL THE NOTES; APPROVING CERTAIN TERMS AND PROVISIONS OF THE NOTES AND THE PLEDGE OF REVENUES TO SECURE THE PAYMENT OF THE NOTES; AND DETERMINING CERTAIN MATTERS IN CONNECTION THEREWITH”; (ii) copies of said note resolution are on file and available for public inspection in the office of the Commission, 6751 Westfield Avenue, Pennsauken, New Jersey 08110, in the office of the Clerk of the Borough of Merchantville, 1 West Maple Avenue, Merchantville, New Jersey 08109 and in the office of the Clerk of the Township of Pennsauken, 5605 North Crescent Boulevard, Pennsauken, New Jersey 08110; (iii) the date of first publication of this notice is October 15, 2021; (iv) any action or proceeding of any kind or nature in any court questioning the validity or proper authorization of notes provided for by said note resolution, or the validity of any covenants, agreements or contracts provided for by the note resolution shall be commenced within twenty (20) days after the first publication of this notice; and (v) if no action or proceeding questioning the validity of the creation and establishment of the Commission, or the validity or proper authorization of notes provided for by said note resolution, or the validity of any covenants, agreements or contracts provided for by the note resolution is commenced or instituted within twenty (20) days after the first publication of this notice, then all residents and taxpayers and owners of property in the municipalities serviced by the Commission and users of the waterworks system and all other persons whatsoever shall be forever barred and foreclosed from instituting or commencing any action or proceeding in any court, or from pleading any defense to any action or proceedings, questioning the validity of the creation and establishment of the Commission, or the validity or proper authorization of the notes, or the validity of the covenants, agreements or contracts.
